Westmead House redevelopment as care home: Update

The following message has been received by Alan, Jill and Hamish from council officers, regarding the building of the 74 bed care home at the former Westmead House site….

Dear Councillor

Further to your reply, the information from my previous response can be shared although I would summarise the main points as follows:
A Notice has been served on the developer of the site under the Control of Pollution Act 1974. This notice sets the hours of working for noise-generating activities which are as follows:
MondayFriday: 8am – 6pm
Saturday: 8am – 1pm
No noisy works on Sundays or Bank Holidays.
An officer has visited the site to investigate reports of work taking place on the afternoon of Saturday 19th December 2015. On this occasion, high winds prevented the crane being used during much of the morning hours. Therefore, the work to remove the blocks from the highway and prevent them causing an obstruction needed to be completed in the afternoon.
The Notice does allow for works outside of the hours in exceptional circumstances, for example where a road closure is required in order to manage traffic movements. Where this is the case, the Council will be notified in advance and it has been recommended that a letter drop be carried out in order to inform residents.

It has been agreed that, during the Christmas period, all works on the site will cease on Tuesday 22 December and will not resume until Monday 4th January 2016.

Poets Estate – 10 Big Actions by the FOCUS Team

Some things we’ve done for you in the Poets’ Estate:-

1) Benhill Rec. We installed new play facilities, planted lavender beds and removed the old skateboard ramp.

2) Westmead Road/Carshalton Grove. We asked the Council to investigate and prevent future floods in this area.

3) Colston Avenue/Coleridge Avenue/Court Drive. We installed new yellow lines to reduce commuter parking.

4) Free Grit. We installed new grit bins in many locations in the Poets’ Estate/Westmead area of the Carshalton Central ward, including at the junction of Sutton Grove/Waterloo Road.

5) Street Trees. We have got planted 81 street trees in Carshalton Central ward many of them in the Poets’ Estate.

6) Mead Crescent. Road was resurfaced.

7) Shirley Avenue. Road and pavements were resurfaced.

8) Westmead Allotments. Better secure fencing installed.

9) Shorts Road/West Street Footpath. We asked the council to clear dog mess and asked police to monitor the area.

10) Wrythe Rec. We installed new play facilities in the rec. We asked that the railings are refurbished and work is underway.

And….We have also kept residents informed and supported residents in the various planning applications affecting our area. Examples are the Carshalton Athletic Football Club’s applications for 3G plastic surface for the football pitch and extended hours of lighting both of which were unanimously refused by Sutton Council’s planning / development control committee.

More and More Housing…

A lot of new housing and special care/residential developments have been completed in Carshalton Central ward in recent years:-

1) Coleridge Avenue, Poets’ Estate (4 detached houses) replacing one 1920s detached house.

2) Carter House/Denny House/Jennings House, 229-245 Carshalton Road/1B and 1c Shorts Road, Carshalton (44 flats) on site of a former terrace of 9 shops with flats above.

3) Nicole Lodge, 2 Carshalton Park Road (on the site of former Texaco Garage) (12 flats in a new “conservation-area-sympathetic” neo-Georgian block, plus 2 flats at no. 33 Pound Street).

4) Doric House, Carshalton Grove (11 flats).

5) Hillside, 163 Carshalton Road (3 new roof top flats above a 1970s block of flats).

6) Lakin Close/2-4A Rotherfield Road (6 new houses in the close, 3 new houses in Rotherfield Road replacing 4 inter-war detached houses/bungalow).

7) The Park/Corbould Close (conversions/alterations of former 1920s Carshalton War Memorial Hospital) (13 houses). In the Carshalton Park Conservation Area.

8) Ashcombe Court, The Park (10 new flats replacing former nurses’ care home).

9) Corbould Close (8 new residential care flats in grounds of Carshalton War Memorial Hospital).

10) Cedar Close off Salisbury Road (9 new mews style houses replacing former special health care bungalows/houses).

And there’s more to come:-

1) Cowper Avenue/Byron Avenue/Kingsley Avenue/Westmead Road (74 bed care home and some 2 storey houses on former Westmead House site). Now under construction.

2) Former Trolleybus Depot site, Westmead Road. Redevelopment/construction work still to start.

Westmead House Demolition Works – Environmental Health Inspector visits…

A message is just in from the Council’s Environmental Health Inspector…

Dear Cllr Whitehead

Environmental Protection Act 1990. Re: Complaints about Dust and Noise. Westmead House, 123 Westmead Road, Sutton SM1 4JH

Thank you for your recent enquiry regarding potential dust and noise nuisance arising from the construction/demolition works taking place at the above address.

I visited the site on Tuesday 18th March and spoke to Mr Freeman, the person in charge of the site at the time. At the time of my visit, no noisy works were taking place. The front of the building is still in place and the remaining walls are sheeted. These remaining walls provide some protection from dust and noise to the properties to the south of the site.

However, demolition has already taken place to the north of the site and the perimeter is only surrounded by temporary metal mesh fencing. I witnessed a workman on the site who was trying to dampen down dusty materials with water from a hose. However, I observed that dust from the area where demolition had taken place was being wind whipped and the direction of the wind was taking the dust towards Kingsley Avenue. I discussed the control of dust with Mr Freeman and asked why there was not solid hoarding around the site. Mr Freeman explained that solid hoarding is to be erected but that some demolition had to take place first in order to provide the space for hoarding. They are now in the process of erecting the hoarding but owing to the existing concrete foundations, this will take 7-10 days to complete. I appreciate that, during this period, there is the potential for dust to leave the site boundary. Therefore, it was agreed that they would:-

a)    Increase the amount of damping down of the dust with water;

b)    Carry out regular visual checks so that they respond promptly to changes in weather conditions;

c)     Phase the erection of hoarding so that those most at risk of being affected by dust are shielded first.

I have spoken to Mr Freeman again today who has informed me that they had tried to put up temporary sheeting on the metal barriers but this was increasing the risk of the barriers toppling over and thus there was a potential to cause injury. Therefore, he is meeting with the Managing Director today and will be discussing alternative options for temporary screening until more permanent hoarding can be erected.  I am satisfied that they are taking steps to control the noise and dust on site and we will be monitoring the situation. In the meantime, residents are reminded that to contact Environmental Health, they should ring the call centre number which is 020 8770 5000.

The end of Westmead House, 123 Westmead Road is nigh. Carshalton Central Cllr. Jill Whitehead reports: “As previously reported in our FOCUS newsletters, the rear part of the site will be developed as houses, and the front and middle as the 74 bed care home which Alan, myself and Hamish opposed and which Sutton Council’s Development Control Committee also opposed. Alas permission to build the care home was granted by an unelected planning inspector (a Government official) based in Bristol.”

Proposed Sainsbury’s, 123 Westmead Road – Licensing News – Cllr. Alan Salter reports back

Following a successful redevelopment appeal to the Department for Environment at Bristol, for Westmead House, a full planning application has been lodged by Sainsbury`s for shopfront alterations to the ground floor which they propose leasing as a Sainsbury`s Local.  At a special Licensing Sub Committee hearing on 10th February, I raised residents` concerns regarding parking, licensing and delivery hours and anti-social behaviour. Sainsbury`s had originally  wanted a 24-hour licence for the sale of alcohol. This has been reduced to the hours of 7 a.m.-11 p.m., and the Committee reserves the right to review the situation, if there is a perceived increase in anti-social  behaviour in the surrounding area, or breaches of delivery times, restricted to the same hours. C.C.T.V. will monitor movements, and could be used as evidence to support any future restrictions. 

Westmead House is located between Cowper Avenue and Kingsley Avenue on Westmead Road, Poets’ Estate, Sutton.

Westmead House, 123 Westmead Road – Demolition Commences…. Councillors Ask Planning Officers to Step In….

Local councillors Jill, Alan and Hamish took up local residents complaints about:-

– Introduction of a noisy generator – in fact, Jill could hear this generator from her house in the Poets’ Estate at the present time (it was 7.45pm on Monday evening) with the windows shut, and double glazing in place. Her house is two streets away.

– Introduction of large plant and equipment blocking people’s houses, their entries and exits, and taking out their parking spaces

– Working until 8pm on Sunday night (last night), with lots of noise, vibration and shaking of houses

Councillors have asked to know what will be done to enforce the building conditions for this site bounded by Westmead Road to the south, Cowper Avenue to the west, Byron Avenue East to the north and Kingsley Avenue to the east. This site is very very close to areas of terraced homes so many people are taking the pain from the demolition and building works. Residents are also concerned about dust and grit, and the possibility there might be asbestos being removed.

Dear Councillor

Thanks for the email. There were a number of conditions attached to the planning consent (granted on appeal),  one of which provides restrictions on the times of site works.  A further condition also requires the submission of a method statement for the control of site parking and loading/unloading.

I understand that my building control officers have been dealing with urgent issues relating to demolition of the current building on the site & there has been some urgency to those works due to the building being in a dangerous structural condition.  I will need to talk further to both building control and planning staff tomorrow morning regarding the detail, but it seems that this urgency may have required  operations to commence for a short time outside of  controlled hours.  We will be having an urgent conversation with the developer to establish the position regarding compliance with those conditions, and I will let you know the outcome once that has taken place.

My staff are also liaising with the Environmental Health team from public nuisance angle.

Clearly there will be some level of disturbance that will result from works on this site as they progress, but I agree that it is important that works take place in accordance with an approved schedule and that disturbance is kept to a minimum.

I will come back to you as soon as I have further details and the further discussions have taken place…

Sainsbury’s at Westmead Business Centre site: Change to Proposed Licensing Hours

Cllr. Jill Whitehead says:

I have heard from Mr Richard Winch in the Council’s Licensing Dept. in regard to the proposed new Sainsbury Store on the site of Westmead House, which would be situated under the proposed care home.

The applicant has now amended the hours applied for to match those of the planning conditions as per the decision of the Planning Inspectorate last year. The opening hours are now 07:00 to 23:00 every day (as opposed to the originally proposed 24 hours per day). This compares with the following local stores:

  • Tesco, Lower Road – licensed for sale of alcohol from 06:00 to 23:00 everyday
  • Londis, 121 Westmead Road – Monday to Saturdays  – licensed for sale of alcohol from 08:00 to 23:00 and Sunday 10:00 to 22:30
  • BP, 322 – 332 Carshalton Road – licensed for sale of alcohol from 08:00 to 23:00 everyday
  • Co-op, 44 High Street, Carshalton – Monday to Saturdays  – licensed for sale of alcohol from 07:00 to 23:00 and Sunday 10:00 to 22:30
  • Sainsbury’s, 52 – 56 High Street, Carshalton – licensed for sale of alcohol from 07:00 to 23:00 everyday

The plan indicates that the entire Sainsbury’s premises will be 336sq metres. Tesco Lower road is 294 sq metres and BP is 240sq metres.  If residents wish a ward councillor to represent you, the hearing of the subcommittee is set to take place on Monday 10th Feb, 14:30 at the Civic Centre.

The licensing committee can only consider licensing matters (i.e. the sale of alcohol in this instance), and as the applicants have now changed their overall hours of operation to match other local outlets selling alcohol, this may be more difficult to challenge, unless we can prove demonstrable harm would be caused through this store selling alcohol at this site (e.g. anti-social behaviour).

Sainsbury’s and Westmead Business Centre – Latest News

Cllr Jill Whitehead says: It is now a year since the Planning Inspectorate overturned Sutton Council’s rejection of Java Capital’s application to build a 74 bed care home for elderly dementia patients on the site of Westmead House (also known as 123 Westmead Road), with integral ground floor convenience store. A site notice has recently gone up on Westmead Business Centre giving notice of a Licensing Application (26508/1729/171213103726) by Sainsbury’s in respect of the store, to sell alcohol from 7am to 11pm, seven days a week, which also states that the store will be open 24 hours per day, every day of the week. Residents are invited to send in their comments to the Council’s Licensing Department at the Civic Offices, Sutton by 15th January 2014.

Cllr Hamish Pollock adds: “As residents will be aware, your local councillors fought the planning application partly on the basis of lack of parking in narrow roads of terraced housing, and in increase in traffic congestion. The entrance to the store is given as Cowper Avenue on the plans. Long opening hours (there does not yet seem to be a planning application for these) and licensing hours will encourage more traffic and an increase in anti- social behaviour. There are already a number of outlets selling alcohol in this shopping parade. This store is right on the edge of the residential area, abutting the popular Poets’ Estate, and to date anti-social behaviour has been low but this may not remain the case.”

Cllr Alan Salter says:  A planning application has been submitted for a non-material amendment to a scheme already approved by the council (C2011/64032 and C2012/66531). This is for the rear of Westmead House where approval was given in November 2011, amended in December 2012 for:

  • Four 4-bedroom semi–detached homes on Kingsley Avenue with integral parking spaces,
  • Four 3-bedroom semi-detached homes in Cowper Avenue with insetted parking spaces away from the road in Byron Avenue East,
  • One four-bedroom detached house with integral parking space at the corner of Kingsley Avenue and Byron Avenue East.  

The planning amendment is to adjust the roof of the detached house planned for the corner of Kingsley Avenue and Byron Avenue East, as per the drawings supplied to the council. It will be decided by officers as it is a minor amendment. This activity would imply that the construction of these homes could be imminent, and may take place in 2014. Building has to take place within three years of planning permission being granted or the permission falls. Planning permission can of course be renewed. More in a future posting/FOCUS leaflet!

Dear Councillor,

I have been in contact with the agents of Westmead House that are likely to be appointed by the new developers to discharge the conditions on the planning permissions for the development of the site. They have advised
me that it is the intention to develop the residential part of the site (not the care home element which I believe is under different ownership). The proposal is to develop in accordance with permission 66531 (4 three bed
semi-detached houses fronting Cowper Avenue) and the remainder of the larger permission 64032 (5 houses fronting Kingsley Avenue).

The new owners have only just taken control of the site and the recent works have been in respect of ensuring that the site is safe and secure and ready for development, following their initial possession of the site. I do not believe that any further works are proposed other than this – but please do let me know if this is not the case.  I am expecting applications for the discharge of conditions in respect of both applications to be submitted within the next few weeks.
